These Terms of Service (‘Terms’) govern your access to and use of the services, websites, and applications offered by Boat Inc. (‘Boat Inc.’, ‘we’, or ‘us’). By accessing the Boat.com website and AI Platform, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing the Boat.com AI Platform, you agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you are agreeing to these Terms for that organization.

2. User Accounts & Security

You must provide accurate and complete information to register for an account. You are responsible for all activities that occur under your account. To protect your account, we utilize 2-step verification via SMS. You are responsible for maintaining the confidentiality of your login credentials. Boat Inc. reserves the right to terminate accounts that violate our AI Prohibited Use Policy.

3. SMS & Mobile Messaging Terms

By opting in to receive SMS messages from Boat Inc. for 2-step verification and account security, you agree to the following:

Program Description: Boat Inc. sends one-time passcodes (OTP) via SMS to verify your identity upon login or for critical account security alerts.
Message Frequency: Message frequency varies based on user interaction and login attempts.
Pricing: Message and data rates may apply from your wireless provider.
Opt-Out: You can cancel the SMS service at any time. Just text “STOP” to the number from which you received a message. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed.
Support: If you are experiencing issues with the messaging program you can reply with the keyword “HELP” for more assistance, or you can contact us directly.
Carrier Liability: Carriers are not liable for delayed or undelivered messages.

4. AI Platform License

Subject to these Terms, Boat Inc. grants you a non-exclusive, non-transferable, revocable license to access and use the AI Platform for its intended purpose of boat listings, information retrieval, and industry queries.

5. Ownership of Content

As between you and Boat Inc., and to the extent permitted by applicable law, you own the input you provide to the AI Platform. By using the Service, you grant Boat Inc. a worldwide, royalty-free license to use, host, and store your inputs and outputs to provide and improve the Services.

6. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ‘AS IS’. BOAT INC. MAKES NO WARRANTIES THAT THE AI-GENERATED OUTPUTS WILL BE ACCURATE, COMPLETE, OR FREE FROM BIAS. USERS SHOULD INDEPENDENTLY VERIFY ALL INFORMATION RELATED TO BOAT LISTINGS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOAT INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE AI PLATFORM.

7. Governing Law

These Terms shall be governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions.
